REGULATIONS

1.General Terms

1.1 These Terms of Use, hereinafter referred to as the "Terms of Use", govern the use of the website www.darkluxoak.com, hereinafter referred to as "darkluxoak.com".
1.2 WAY UP SIA, registration no. 44103093876 , address: 10 Muzeja Street, Ainaži, Salacgrīvas County, Latvia, LV-4035, hereinafter referred to as WAY UP, SIA, provides the content available on darkluxoak.com and provides services in accordance with the Terms of Use.

1.3.User is a natural or legal person with legal capacity who shops at darkluxoak.com or uses other darkluxoak.com services. Minors between 14 and 18 years of age use the darkluxoak.com services only with the permission of a parent or guardian, unless they have their own income.
1.4 If the User purchases goods offered by darkluxoak.com, these Terms of Use shall be deemed to be a legally binding document setting out the rights and obligations of the parties in relation to the purchase of the goods, payment for them, as well as the conditions of delivery and return of the goods.
1.5 If the User purchases goods on darkluxoak.com, the User shall be deemed to have read and accepted these Terms of Use. By accepting the Terms of Use, the User confirms that he/she has the right to purchase goods from the darkluxoak.com online shop.

1.6 If the User attempts in any way to harm the operation, stability, security or otherwise does not comply with these Terms of Use, WAY UP SIA has the right to restrict the User's access to the darkluxoak.com online store.
1.7 WAY UP SIA reserves the right to unilaterally amend and supplement the Terms of Use. When the User shops at darkluxoak.com, the Terms of Use in force at the time of ordering the goods shall apply, therefore the User must consult the Terms of Use with each purchase.
1.8 WAY UP Ltd reserves the right to change the price of the goods or to set a special price for the goods. Goods are sold to the User at the prices prevailing at the time of order.

2. Protection of personal data

2.3 By accepting these Terms of Use, the User agrees to the sending of notifications to the e-mail address provided, which are necessary for the provision of order, payment and delivery information.
2.4 WAY UP Ltd guarantees that the User's data will only be used for the purchase of goods and for direct marketing purposes.
2.5 WAY UP SIA SIA undertakes not to disclose the User's personal data to third parties, with the exception of WAY UP SIA SIA's partners who ensure the delivery of goods to the User or provide other services related to the execution of orders.
2.6 Upon delivery of the goods, the recipient may be asked to present an identity document to identify the person.

3. Conclusion of the sale and purchase agreement

3.1 The contract of sale between WAY UP SIA SIA and the User shall be deemed to be concluded from the moment when the User has placed an order by selecting the product(s). The User is obliged to pay for the goods in the manner and within the time limits set out in the Terms of Use.
3.2 Purchase contracts are registered and stored in the darkluxoak.com database.
3.3 WAY UP SIA SIA agrees to deliver the goods purchased by the User to the address specified by the User.
3.4 If WAY UP SIA fails to contact the User within 3 (three) working days of the order being placed, the order will be cancelled,
3.5 In the event of an emergency, where due to unforeseen circumstances, WAY UP SIA SIA cannot provide the goods purchased from the online shop darkluxoak.com. WAY UP SIA undertakes to offer a similar product. If the User does not agree, WAY UP SIA shall refund the money paid as soon as possible, but no later than within 30 (thirty) calendar days.
4. Prices and payment arrangements
4.1 The prices of the goods in the darkluxoak.com online shop are in Euro, VAT is not included in the price.
4.2 The User shall pay for the goods in the following ways:
4.2.1. by using the bank-link services;
4.2.2. by bank transfer;
4.2.3. in cash on receipt of the goods at the office of WAY UP SIA

5. Delivery
5.1 The User undertakes to specify the exact delivery address when selecting the delivery service.
5.1.1 The goods may be delivered by WAY UP Ltd or its authorised representative;
5.1.2 The User undertakes to accept the goods from the courier;
5.1.3 If the User's order amount is more than 500.00 (five hundred) EUR, the delivery is free of charge.
5.1.4 WAY UP SIA reserves the right to change the order amount for which delivery is free.
5.2 WAY UP SIA SIA will use its best endeavours to ensure that the goods ordered are delivered as soon as possible.
5.3 If the User cannot be found at the delivery address provided by the User, WAY UP SIA shall have the right to deliver the goods to any other person of legal age at the address provided, but the User shall have no right to make any claim against WAY UP SIA for delivery of the goods to an unsuitable person.
5.4 If delivery of the goods to the User is not possible due to the User's fault or circumstances beyond the User's control (the User has provided an incorrect address, the User cannot be found at the address provided, the address provided cannot be accessed, etc.), the goods are not resent, the order is cancelled, the User receives a refund for the goods only, the delivery fee is not refunded.

5.5 Upon receipt of the goods, the User or his representative shall check the conformity of the goods with the goods ordered and sign the invoice, delivery note or other handover/acceptance document. By signing the invoice, delivery note or other handover/acceptance document, the User or his representative certifies that the goods have been delivered in good condition. In all cases where the courier delivers the goods to the User, if the packaging of the goods is wrinkled, wet or otherwise damaged on the outside, the User shall indicate (comment) on the acknowledgement of receipt or write a separate document concerning such defects. The User must do so in the presence of the courier. WAY UP SIA shall not be liable for any defects in the goods which were apparent at the time of delivery but were not specified in the delivery confirmation.

6. Quality of goods

6.1 The characteristics of all goods sold on darkluxoak.com are set out in the description of each item.
6.2 The darkluxoak.com goods are subject to the warranty set out in the relevant legislation.

7. Return of goods

7.1 If the User is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases goods for a purpose not related to his/her business activity), the User may exercise the right of withdrawal. Subject to the provisions of Regulation No 255 of the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contract", the Consumer has the right to return the product purchased at darkluxoak.com back to WAY UP SIA within 14 calendar days.
7.2 The User shall notify WAY UP SIA of the return in writing (by e-mail), indicating the object of the return and the order number.
7.3 Returns are subject to the following conditions:
7.3.1. the returned item(s) must be in their original packaging;
7.3.2. the goods must not be damaged;
7.3.3. the goods have not been used and have not lost their marketable appearance (labels, safety films, etc.) (this does not apply to products already damaged at the time of delivery);
7.3.4. the returned goods must be in the same condition as when they were received;
7.3.5 WAY UP Ltd. has the right to refuse to accept the return of the goods if the time limits for the return of the goods have not been complied with;
7.3.6 The User must bear the cost of the return;
7.3.7. refunds for returned goods shall be made only by bank transfer to the bank account specified in the user's return document.

7.4 The User is responsible for maintaining the quality and safety of the goods during the period of exercise of the right of withdrawal. The User shall be liable for any diminution in the value of the goods if the goods have been used in a manner incompatible with the principle of good faith, including use for purposes other than ascertaining the nature or performance of the goods. The goods must be undamaged, without loss of appearance (labels not removed or damaged, protective films not torn, etc.) and unused. The goods must be returned in their original packaging, in the same condition in which they were received, and must be accompanied by the proof of purchase and other accessories. If the goods are not complete, damaged, disordered or not properly packed, WAY UP SIA has the right not to accept the goods and not to refund the money paid by the User for the goods.
7.5 For goods returned by the User to WAY UP SIA in accordance with the procedure set out in the Terms of Use, WAY UP SIA agrees to refund the User as soon as possible, but not later than within 30 (thirty) calendar days.

8. Information exchange

8.1 WAY UP SIA shall communicate with the User by e-mail, postal address or telephone number. The User may use any of the means of communication listed in the Contact section of darkluxoak.com.

9. Liability

9.1 WAY UP Ltd shall be exempt from any liability in all cases of damages resulting from the User's purchase contrary to the use of darkluxoak.com as set out in these Terms of Use.
9.2 In the event of damages, the guilty party shall indemnify the other party for direct damages.
9.3 WAY UP Ltd. shall not be liable for any discrepancy between the colours, shapes or other characteristics of the goods in the darkluxoak.com shop images and the actual characteristics of the goods.
9.4 WAY UP SIA shall not be liable for any delay in performance or failure to perform or any other failure to perform due to circumstances and obstacles beyond WAY UP SIA's reasonable control, including but not limited to strikes, governmental orders, acts of war or national emergency, terrorist threats or acts, environmental or climatic anomalies, failure of third parties to perform, interruptions in internet connectivity, and computer equipment and software failures. In the event of such force majeure, WAY UP SIA will endeavour to remedy the delays as soon as possible.

10. Other provisions

10.1 The relationship between the User and WAY UP SIA is governed by these Terms of Use, as well as the legislation of the Republic of Latvia.
10.2 In case of any questions or disputes, the User shall contact WAY UP SIA customer service by phone or e-mail. All disputes arising shall be resolved by the parties by negotiation to the extent possible. If no agreement is reached, the dispute shall be referred to court in accordance with the legislation of the Republic of Latvia.

 There are two types of information that WAY UP Ltd may ask you for: anonymous and personal data.
